Terms & Conditions (T&C) – LUCUS

  1. Scope

These Terms and Conditions (T&C) apply to all orders placed through our online shop.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are not related to their commercial or self-employed professional activity.
An entrepreneur is a natural or legal person or a legally capable partnership who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

  1. Conclusion of Contract

By listing the products in the online shop, we make a binding offer to conclude a contract for these items. The contract is formed when you accept the offer for the goods contained in your cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.

  1. Prices and Payment Terms

The prices stated on the product pages include statutory VAT and all other price components.
Payment is made via the payment methods offered in the online shop (e.g., credit card, PayPal, Klarna, Sofortüberweisung).

  1. Delivery and Shipping

Delivery is made within Germany, Austria, and other countries listed in the shipping overview.
Unless otherwise specified, the delivery time is 5–8 business days.
Shipping costs are clearly displayed at checkout.
LUCUS is entitled to make partial deliveries if reasonable for the customer.

  1. Retention of Title

The goods remain our property until full payment has been received.

  1. Right of Withdrawal & Return Costs

Consumers are entitled to a statutory 14-day right of withdrawal. The precise conditions can be found in our Withdrawal Policy.
In the event of a withdrawal, the buyer bears the direct cost of returning the goods.
If goods are defective, damaged, or incorrectly delivered, we cover the return shipping costs.

  1. Refunds

Refunds are issued exclusively to the original payment method used.
For items that are used, damaged, soiled, or returned without original packaging, we reserve the right to issue only a partial refund or to refuse the return.

  1. Warranty

Statutory warranty rights apply. In the case of defects in the delivered goods, the customer is entitled to subsequent performance (repair or replacement). If subsequent performance fails, the customer may reduce the purchase price or withdraw from the contract in accordance with statutory provisions.

  1. Liability

We are fully liable in cases of intent and gross negligence.
In cases of slight negligence, we are only liable for damages resulting from injury to life, body, or health, as well as for damages arising from the breach of an essential contractual obligation (cardinal obligation). In the latter case, liability is limited to the foreseeable, contract-typical damage.

All content, texts, images, and designs on our website are protected by copyright and may not be used without our express consent.

  1. Applicable Law

German law applies.
The contract language is German.

  1. Severability Clause

Should any provision of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
